1) Use of Website

  • You agree to use the Services only for lawful purposes and in accordance with these Terms.
  • You are responsible for the accuracy of information you submit, including traveler names, dates, and payment details.
2) Accounts & Security
  • You may need an account to use certain features. Keep your credentials confidential and notify us of any unauthorized use.
  • We may suspend or terminate accounts for suspected fraud, abuse, or violations of these Terms.
3) Bookings & Payments
  • All bookings are subject to availability and written/email confirmation.
  • Prices are shown in USD unless stated otherwise and are not guaranteed until payment is confirmed.
  • We accept major payment methods displayed at checkout. By paying, you authorize us (or our payment processor) to charge your method of payment.
  • Some tours require deposits; balances are due by the deadline communicated at checkout or in your confirmation email.
4) Cancellations, Changes & Refunds
  • Cancellation and change policies vary by tour, operator, airline, and season. The specific policy will be shown during booking and in your confirmation.
  • Non-refundable items (e.g., certain tickets or permits) will be clearly labeled and are not eligible for refunds.
  • Where eligible, refunds are processed to the original payment method within 7 business days after confirmation from the supplier. Processing times by banks may vary.
  • No-shows are typically non-refundable.
5) Pricing, Taxes & Fees
  • Displayed prices may exclude local taxes, resort fees, park fees, baggage fees, or guide gratuities unless explicitly included.
  • We reserve the right to correct pricing errors. If a material pricing error occurs, you may cancel for a full refund.
6) Travel Documents, Health & Insurance
  • You are responsible for valid passports, visas, permits, and vaccinations required for your itinerary.
  • We strongly recommend comprehensive travel insurance covering medical, trip interruption, and baggage.
  • Entry requirements can change at short notice; check official sources before you travel.
7) Third-Party Providers
  • Many services listed on Tourista are provided by independent third parties (e.g., tour operators, airlines, hotels).
  • Each provider’s terms and policies apply to your booking with them and may supersede parts of these Terms.
  • Tourista is not liable for acts, omissions, delays, or errors of third-party providers.
8) Changes, Delays & Force Majeure
  • Itineraries may change due to weather, safety, governmental actions, strikes, or events beyond reasonable control (“Force Majeure”).
  • In such cases, reasonable alternatives will be sought where possible; refunds are subject to supplier policies.
9) Liability & Disclaimers
  • To the fullest extent permitted by law, Tourista disclaims liability for indirect, incidental, or consequential damages arising from the use of the Services.
  • Except where prohibited, our total liability for claims relating to the Services will not exceed the total amount paid to Tourista for the booking giving rise to the claim.
  • Travel involves risks; you participate voluntarily and assume all risks associated with travel activities.
10) User Content & Reviews
  • By submitting reviews, photos, or other content, you grant Tourista a non-exclusive, royalty-free license to use, display, and distribute such content for Service-related purposes.
  • Do not post content that is unlawful, defamatory, infringing, or invasive of privacy.
11) Prohibited Activities
  • Scraping, automated data extraction, or reverse engineering of the Services.
  • Interfering with site security or attempting unauthorized access.
  • Using the Services to commit fraud or misrepresent identity.
12) Intellectual Property
  • All content, trademarks, logos, and software on the Services are owned by or licensed to Tourista and protected by applicable laws.
  • You may not copy, modify, distribute, or create derivative works without prior written consent.
13) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share your information.

14) Governing Law & Dispute Resolution
